ArastaLink Terms of Use

You may use the Site only if:

• you are at least 18 years old (or the age of majority where you live), and
• you have legal capacity to enter into contracts.

If you use the Site on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.

ArastaLink provides information and tools to request and manage services related to assisted purchasing, sourcing, consolidation, packaging, fulfillment, and international shipping from Türkiye, including services for individuals and businesses.

ArastaLink is not:

• a bank, payment institution, or e-money issuer;
• a customs broker or government agency;
• a marketplace that owns or controls third-party merchants whose links you submit.

Any services you order are governed by separate service terms (e.g., Individual Service Terms / Distance Service Contract and/or Business Service Terms and/or a signed agreement). These Terms govern website usage, not the full commercial relationship.

Some features require an account. When you create or use an account, you agree to:

• provide accurate, current information;
• keep your login credentials secure;
• promptly notify us of any unauthorized access or suspected breach.

You are responsible for all activities under your account. We may suspend or disable accounts that appear compromised or are used in breach of these Terms.

The Site may allow you to submit:

• product links or descriptions,
• shipping details,
• messages and supporting documents,
• business inquiries.

You understand and agree:

• information on the Site (including estimates, timelines, availability indications, or general guidance) may change and may be incomplete;
• any availability check, quote, shipping estimate, or timeline is indicative until confirmed under the applicable service terms or agreement.

You should not rely on Site content as legal, customs, tax, or sanctions advice.

Because we operate in Türkiye and work with cross-border shipments and payments, we maintain compliance controls. By using the Site, you agree that:

5.1 Prohibited use

You will not use the Site to request, facilitate, or support:

• unlawful activity, fraud, money laundering, or terrorism financing;
• sanctions evasion or dealings with sanctioned persons, entities, or restricted goods;
• shipment, purchase, or handling of illegal or prohibited goods, or goods restricted under applicable laws, carrier rules, or marketplace rules.

5.2 Verification and information requests

We may require identity verification and/or business documentation (including beneficial ownership information for business users), and we may request information about goods, end users, or the purpose of transactions.

We may refuse, pause, or cancel any request or service if:

• required by law or a competent authority;
• we cannot complete verification to our satisfaction;
• we believe the request presents compliance, fraud, or operational risk.

The Site may display or allow submission of links to third-party stores, marketplaces, carriers, or other websites. We do not control third-party sites and are not responsible for their content, availability, pricing, or policies.

Your use of third-party sites is at your own risk and subject to their terms.

The Site and its content (text, branding, design, logos, graphics, and software) are owned by or licensed to ArastaLink and protected by intellectual property laws.

You may use the Site for its intended purpose. You may not:

• copy, reproduce, distribute, publicly display, sell, lease, or create derivative works from the Site content;
• reverse engineer, decompile, or attempt to extract source code (except where prohibited by law);
• use our trademarks without our prior written consent.

If you submit content to the Site (including product links, messages, files, or business details), you:

• confirm you have the right to submit it; and
• grant ArastaLink a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process such content solely to operate the Site, evaluate requests, provide services, comply with law, prevent fraud, and enforce these Terms.

You remain responsible for the content you submit.

You agree not to:

• use the Site in a way that disrupts or harms the Site or other users;
• attempt unauthorized access to accounts, systems, or data;
• scrape, crawl, or index the Site using automated means without our permission;
• upload malware, viruses, or harmful code;
• submit false or misleading information.

We may investigate and take appropriate action for violations, including suspension, termination, and reporting to authorities where required.

We may suspend or terminate your access to the Site (or any part of it) at any time if:

• you breach these Terms;
• we suspect fraud or unauthorized activity;
• required by law or a competent authority; or
• necessary to protect the Site, our business, or other users.

Termination of Site access does not automatically terminate any separate service agreement, which will be governed by its own terms.

To the maximum extent permitted by law:

• The Site is provided on an "as is" and "as available" basis.
• We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Site will be uninterrupted, error-free, or secure.
• We do not warrant the accuracy or completeness of any content on the Site.

To the maximum extent permitted by law, ArastaLink will not be liable for any:

• indirect, incidental, special, consequential, or punitive damages;
• loss of profits, revenue, business, goodwill, or data;

arising out of or related to your use of (or inability to use) the Site.

Our total liability for claims relating to the Site will not exceed the greater of:

• the amount you paid us (if any) for Site access in the preceding 12 months, or
• USD 100.

This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations; in that case, liability is limited to the maximum extent permitted.

Important: These limitations concern the Site. Any liability related to paid services (purchasing, consolidation, fulfillment, shipping, refunds) is governed by the relevant service terms or written agreement.

You agree to indemnify and hold harmless ArastaLink, its directors, officers, employees, and contractors from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from:

• your misuse of the Site;
• your breach of these Terms;
• your violation of law or third-party rights;
• content you submit.

Our processing of personal data is described in our Privacy Notice (KVKK) and, where applicable, our Cookie Policy, each available on the Site. By using the Site, you acknowledge you have read those notices.

We may update these Terms from time to time. We will post the updated version on the Site and update the "Last updated" date. Changes take effect when posted, unless stated otherwise.

If you continue using the Site after changes, you accept the updated Terms.

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or your use of the Site shall be submitted to the competent courts of Istanbul, Türkiye, unless mandatory law requires otherwise.
